These Terms of Use ("Terms") govern your use of Night Calm (the "App"), a mobile application provided by Night Calm ("we", "us", or "our"). By using the App, you agree to be bound by these Terms.

1. Scope of Application

1. These Terms apply to all aspects of the relationship between you and us regarding the use of the App.
2. Any supplementary terms or guidelines posted within the App form part of these Terms.
3. In the event of any conflict between these Terms and supplementary terms, the supplementary terms shall prevail.

2. Fees and Payment

1. The basic features of the App are available free of charge.
2. The App may offer additional features through a one-time in-app purchase.
3. Payments are processed through Apple App Store or Google Play Store. Payment terms are governed by the respective store's terms of service.
4. Refunds for in-app purchases are subject to the refund policies of Apple Inc. or Google LLC. We do not process refunds directly.

3. Prohibited Activities

You agree not to engage in any of the following activities in connection with the App:

1. Violating any applicable law, regulation, or public order
2. Engaging in any activity related to criminal conduct
3. Infringing copyrights, trademarks, or other intellectual property rights contained in the App
4. Disrupting or interfering with the App's servers or network functionality
5. Reverse-engineering, decompiling, or disassembling the App
6. Reproducing, redistributing, or repurposing the App's content without authorization
7. Interfering with the operation of the App
8. Attempting unauthorized access to the App or its systems
9. Any other activity we deem inappropriate

4. Service Suspension

1. We may suspend or interrupt the App, in whole or in part, without prior notice for any of the following reasons:
   1. System maintenance or updates
   2. Force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters
   3. Any other reason we determine makes provision of the App difficult
2. We shall not be liable for any disadvantage or damage incurred by you or any third party due to suspension or interruption of the App.

5. Intellectual Property

1. All intellectual property rights in the App and its content (including audio, images, text, design, and software) belong to us or their rightful owners.
2. You may not reproduce, modify, distribute, publicly transmit, or otherwise use the App's content beyond what is necessary for using the App.

6. Disclaimer of Warranties and Limitation of Liability

1. We do not warrant, expressly or impliedly, that the App is free from defects (including defects in safety, reliability, accuracy, completeness, fitness for a particular purpose, security, errors, bugs, or rights infringement).
2. We shall not be liable for any damage arising from or in connection with the App, except in cases of our willful misconduct or gross negligence. However, this limitation shall not apply where the contract between us constitutes a consumer contract under applicable consumer protection laws.
3. Even in cases covered by applicable consumer protection laws, we shall not be liable for damages arising from special circumstances due to our negligence (excluding gross negligence), whether or not such damages were foreseeable.

7. Medical Disclaimer

1. The App is not a medical device or medical treatment. It is provided solely for relaxation support and is not intended to diagnose, treat, cure, or prevent any medical condition.
2. If you experience persistent difficulty sleeping, please consult a qualified medical professional.
3. Use of the App is not a substitute for professional medical advice.

8. Changes to the App

We may change the content of the App or discontinue the App without notice. We shall not be liable for any damage caused to you as a result.

9. Changes to These Terms

1. We may modify these Terms without obtaining individual consent from users in the following cases:
   1. When the modification is in the general interest of users.
   2. When the modification does not conflict with the purpose of the agreement for using the App and is reasonable in light of the necessity and substance of the modification.
2. We will notify users in advance of any modification, including the content of the modified Terms and their effective date.

10. Privacy

We handle information obtained through the App in accordance with our separately established Privacy Policy.

11. Governing Law and Jurisdiction

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of Tokyo District Court as the court of first instance.
